Title 42 Ruling: We Need Solutions That Promote Order, Human Dignity

WASHINGTON, D.C. This afternoon Federal Judge Emmet Sullivan blocked the use of Title 42, initially a pandemic-era policy that has been used to expel migrants at the border. Judge Sullivan found it “arbitrary and capricious in violation of the Administrative Procedure Act.”

“Title 42 has reduced order at the border, proved dangerous for migrants and benefited smugglers and cartels,” said Jennie Murray, President and CEO of the National Immigration Forum. “It encourages stealth and repeated attempts to enter the U.S. rather than orderly processes at ports of entry, and it has endangered migrants blocked from seeking humanitarian relief.” 

“In the short term, we expect the end of Title 42 will pose additional challenges for border patrol. However, this policy was never the answer. Our country should implement border security solutions focused on order, human dignity and respect for people in need.” 

Earlier this year, the National Immigration Forum published “42 Border Solutions That Are Not Title 42.”
