Americans Agree: Everyone Should Have the Right to Defend Themselves from Deportation

By a 40-point margin, Americans support the opportunity for people facing deportation to make their case and defend themselves.

A Bullfinch Group and National Immigration Forum survey of 1,200 adults, including 1,000 registered voters, found that after reading a brief definition of due process, 63% of adults supported the constitutional right for anyone facing deportation, vs. 23% opposed. The remaining 14% were unsure.

“Due process is essential to keeping American communities safe and immigration processes orderly,” said Jennie Murray, President and CEO of the National Immigration Forum. “This bedrock American value protects all of us.

“Americans do not want our immigration system to undermine the rule of law. We look forward to working with leaders on approaches that uphold fairness and due process.”

The National Immigration Forum, in conjunction with The Bullfinch Group, conducted a nationwide online survey fielded May 9-13, 2025, among 1,200 adults, of whom 1,000 respondents were registered voters. Sampling controls were used to ensure that a proportional and representative number of respondents were interviewed from demographic groups such as age, gender, political affiliation, race, and geographic region. The margin of error for registered voters is ±3.1% at the 95% confidence interval. The margin of error for adults is ± 2.83% at the 95% confidence interval.
